چکیده مقاله:

The purpose of this research was to compare Islamic human rights and Western human rights. The idea of human rights can be seen as the realization of one of the important human ideals in creating a desirable life. The concept of human rights is a concept based on which the human right to have rights is recognized and the government is required to respect individual rights and freedoms and refrain from encroaching on basic freedoms. Human rights are the rights that people have due to their human nature, and these rights are equal for everyone, because people have equal leaven and nature. God has given these rights to humans and no one has the right to take them away from people, this issue has always made the restoration of human rights one of the concerns of religions, schools, governments and international organizations. The main research question is, what are the differences and similarities between Islamic human rights and Western human rights? The findings of the research show that, in the application of the human rights of Islam and the West, it is possible to find common principles and different examples in this field, stating that the basis of universal human rights is natural or contractual and situational rights, while Islamic human rights are based on humanitarian jurisprudence and divine revelation. Western human rights are not universal and are mostly based on Western values and designed for liberal democracy systems, but Islamic human rights have a general and universal perspective based on the principle of inherent and acquired human dignity. Western human rights are mostly negative, but Islamic human rights have a positive approach.
